CHINA 2013

China undoubtedly stands as one of the foremost nations in the world. Heir to a long legal tradition, China has undertaken a comprehensive reform of its laws, legal system and institutions, including the judiciary, to meet the requirements of the newly joined World Trade Organization.

In this context, it is essential for members of the legal profession and scholars interested in the new world order to understand the major components of the Chinese legal system.

A joint effort of the Université de Montréal Faculty of Law and of one of the most prestigious Chinese law schools, the China University of Political Science and Law, the summer school program addresses the needs of jurists from Quebec, other Canadian provinces and abroad. This summer school program combines basic training in Chinese law with a unique cultural experience to allow students to discover this vast land, great country, and historic civilisation.

Eligibility

The summer school program is offered to anyone with satisfactory legal training seeking an introduction to the Chinese legal system.

A letter of motivation (1-2 pages) (attention to Ms. Marie-Claude Rigaud) is required.

Eligible Students Courses DRT-3000 (Undergraduate):

  • Regular students: Undergraduate students registered at the Université de Montréal Faculty of Law who, if in their first year, have earned at least 15 credits on the day they apply for the summer school program;
  • Through bilateral agreement (CREPUQ): Undergraduate students registered at a Quebec faculty of law who, if in their first year, have succeeded a semester (minimum five courses) on the day they apply for the summer school program;
  • Independent students: Undergraduate students of any other university, jurists, or any other persons specifically admitted by the Assistant Dean of the Université de Montréal Undergraduate Law Program.

Eligible Students Courses DRT-6000 (Graduate):

  • Regular students: (1) Undergraduate students eligible for the "Honor Program" or the "Combined Program: LL.B-Graduate Studies"; (2) Students registered at the Université de Montréal Faculty of Law in a graduate program;
  • Through bilateral agreement (CREPUQ): Students registered in a graduate program at the Faculty of Law of any other Quebec university;
  • Independent students: Students registered in a graduate program at the Faculty of Law of any other university, jurists or any other person specifically admitted by the Assistant Dean of the Université de Montréal Graduate Law Programs to the condition of meeting the admission criteria of a Université de Montréal graduate law program.

Courses Offered

Undergraduate :

  • DRT 3031 (3 cr.) - Chinese Judicial System (block C)
  • DRT 3131 (3 cr.) - International Aspects of Chinese Law  (block D)

Graduate :

  • DRT 6859 A (3 cr.) - Droit comparé avancé
  • DRT 6820 A (3 cr.) - Droit commercial avancé ou DRT 6965 A (3 cr.) - Droit des affaires avancé

Although courses are generally given in the morning, there is a number of afternoon sessions as well. Some meetings are organized by jurists in China. The participants can generally attend to a trial.

Chinese Law Study Program 2013 (Subject to change).

Professors

Professors of the China University of Political Science and Law or lawyers give the classes, while professors from the Faculty of Law of the Université de Montréal attend classes and conduct evaluations.

Language

Courses are given in English. A Chinese law professor who is fluent in French and English provides assistance as needed.

Credit Rating

  • Depending on students, 6 undergraduate course credits or 6 graduate course credits* (pursuing a Master of Laws (LL.M.), DESS or attestation); AND
  • A certificate from the China University of Political Science and Law.

* Credit ratings vary based on programs (undergraduate or graduate). Students not registered at Université de Montréal should contact their academic dean in order to see if they will receive credits from their law school.

Lodging

Participants stay at a hotel, a threestar establishment with air conditioning. The hotel is a 5 minutes walk from teaching facilities and close to major bus routes to various parts of the city of Beijing.

This amount includes: course documents, double occupancy lodging at the hotel, breakfast, lunches during the two first weeks, airport pickup (on Friday May 6), accompanying person fees, welcoming and closing banquets and entrance fees to several tourist attractions in Beijing.

This amount does not include: course fees, airfare from Montreal to Beijing, Chinese student visa (obtained via the Chinese embassy in Ottawa), medical insurance and meals not otherwise covered by the program.

La Direction des relations internationales (DRI) will contribute to the financing of the students of Université de Montréal. A certain amount will be allowed to students as a scholarship. For more information, please see the original French version of this General Information.

Course Fees

(1) Students from Université de Montréal will be charged by the Université de Montréal Service of Finance (6 credits);

(2) Students from other Quebec Law schools who want to participate through a bilateral agreement (CREPUQ) must pay the scholar fees to their own institution;

(3) Students from other universities, jurists and any other students admitted by the Assistant Dean should contact him.

Final admission to the summer school program is conditional to the proof of payment of course fees.

Organized Outings

In Beijing (fees included in the package)*: Great Wall, Ming Emperors' Tomb, Forbidden City, Tiananmen Square, Haidian People's Court, Old Beijing. Participants will also attend a criminal trial and visit a local law firm.

Participants will also be able to visit, at their own expense, other tourist attractions in the cities of Shanghai, Xi'an, Hong Kong, ChengDu, etc. between the two courses.

Visa Information

Participants must obtain individual visas by sending to the China Embassy:

(1) The Visa Application form available from the Chinese Embassy Website;

(2) the personal invitation letter they will have received from the Chinese University of Political Science and Law (CUPL); this letter will be received at mid-March; and

(3) any other specified documents (passport, payment).

If you do not respect these formalities, you can violate the Chinese Law.

In order to help you apply the Visas, the Faculty of Law will send a "group package" to Ms. Nicole Geoffroy who is the representative and will go to The Embassy of China in Ottawa. It is an optional service. Some fees of $25 must be paid directly to Ms. Geoffroy for her services.

Compulsory Travel Insurance

All participants must submit proof of travel insurance coverage for the duration of their stay in China.

Cancellation policy

Université de Montréal reserves the right to cancel the Summer School Program for any other circumstances beyond its control.

Registration

People interested by this program shall complete the Registration Form and send it, before February 28, 2013, with a $500 deposit by check to the order of Université de Montréal. Final payment must be received by April 19, 2013.
